Terms of Use

1. Acceptance of Terms

By using the Platera mobile application ("App"), you agree to these Terms of Use. If you do not agree with any part of these Terms, you may not use the App.

2. Description of the Service

Platera is a mobile application for:

Storing information about your pets
Keeping medical records (vaccinations, veterinary visits)
Storing pet documents
Receiving reminders about upcoming procedures
Tracking pet weight

3. Registration and Account

3.1 Creating an Account

To use the App, you must create an account using:

an email address and password, or
Apple Sign In

3.2 Account Responsibility

You are responsible for:

maintaining the confidentiality of your login credentials
all activities performed under your account
promptly notifying us of any unauthorized access

4. Subscriptions and Payments

4.1 Premium Features

The App offers both free and premium features. Access to premium features is provided through a Platera Pro subscription.

4.2 Plans and Pricing

As of the date these Terms are published, the following Platera Pro plans are available:

Monthly subscription: USD 4.99 for a 1-month period with automatic renewal
Annual subscription: USD 39.99 for a 12-month period with automatic renewal

The local price in your currency is displayed in the App Store or Google Play before you confirm your purchase and may differ from the amounts above depending on your region, exchange rate, and applicable taxes. If a free trial is offered for a particular plan, its terms and the post-trial subscription price are shown in the app store before purchase confirmation. As of the date these Terms are published, no free trial is offered.

4.3 Automatic Renewal

Subscriptions are purchased through the App Store (Apple) or Google Play (Google)
Payment is charged to your Apple ID or Google account upon confirmation of purchase
Subscriptions automatically renew for the same period at the price displayed in the app store, unless auto-renewal is turned off at least 24 hours before the end of the current period
The renewal charge is processed within 24 hours before the end of the current period

4.4 Managing Your Subscription

You can manage your subscription and turn off auto-renewal in your Apple ID or Google Play account settings after purchase. Cancellation takes effect at the end of the current paid period.

4.5 Refunds

Refunds are handled in accordance with the Apple App Store or Google Play refund policies. To request a refund, please contact the respective app store's support.

5. Rules of Use

When using the App, you agree:

Permitted:

Use the App for personal, non-commercial purposes
Store data about your pets
Upload documents you have the rights to use

Prohibited:

Use the App for unlawful purposes
Upload malicious content
Attempt to gain unauthorized access to systems
Transfer your account to third parties
Use automated means to access the App

6. User Content

6.1 Your Content

You retain all rights to the content you upload to the App (photos, documents, pet data).

6.2 License

By uploading content, you grant us a limited license to store and process such content solely for the purpose of providing the App's services.

6.3 Responsibility for Content

You are responsible for the content you upload and represent that you have the right to use it.

7. Intellectual Property

The App, including its design, code, logos, and trademarks, is the intellectual property of Platera and is protected by copyright and other applicable laws.

8. Disclaimer of Warranties

The App is provided on an "as is" basis without warranties of any kind. We do not guarantee:

uninterrupted operation of the App
absence of errors or viruses
accuracy or completeness of information

Important: The App is not a substitute for professional veterinary advice. Always consult a veterinarian for medical decisions.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

indirect, incidental, or punitive damages
loss of data or profits
service interruptions

Our total liability is limited to the amount you paid for using the App during the last 12 months.

10. Changes and Termination

10.1 Changes to the Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email at least 14 days before the changes take effect.

10.2 Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms.

10.3 Account Deletion

You may delete your account at any time via Settings → Danger Zone → Delete Account. Upon deletion, all your data will be permanently deleted. An active subscription is not automatically cancelled when you delete your account — please turn off auto-renewal in your Apple ID or Google Play settings before deleting.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

12. Age Restrictions

The App is intended for users aged 16 or older (or the minimum age established by your country's legislation). By using the App, you confirm that you meet this requirement.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to conflict of law rules.

14. Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved through negotiations. If no agreement is reached, disputes shall be submitted to the competent court.

15. Additional Terms for Apple App Store Users

If you downloaded the App from the Apple App Store, the following additional provisions apply to your use of the App. In the event of any conflict between these provisions and other sections of these Terms, the provisions of this section shall prevail for App Store users.

15.1 Parties to the Agreement

You acknowledge that these Terms are concluded between you and Platera, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

15.2 Maintenance and Support

Apple has no obligation to provide any maintenance or support services with respect to the App. Direct any support inquiries to help@platera.app.

15.3 Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Platera.

15.4 Claims

Platera, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

15.5 Third-Party Intellectual Property Rights

In the event that any third party claims that the App infringes that third party's intellectual property rights, Platera, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

15.6 Compliance with Export Laws

By using the App, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.7 Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
